TERMS & CONDITIONS – SURGE LIMITED

THE EMS TRAINING FACILITIES AND STUDIOS (THE “STUDIO”)

The Studio is operated by Surge Limited (the “Company”), whose primary objective is to provide EMS (Electrical Muscle Stimulation) training at the Studio. The Company has appointed a Management team (the “Management”) responsible for the operation of the Studio in accordance with these Terms and Conditions (the “Rules”), which may be updated from time to time at the Company’s discretion.

SERVICE PLAN TERMS

  1. Enrolment & Rules
    a) Enrolment and continued participation are subject to the Rules in force, which the Company may amend at any time.
    b) Applicants must be at least 18 years old, complete an application form, and provide any additional documents requested.
    c) The Company reserves the right to accept or reject any application without providing a reason.
    d) Membership is personal, non-transferable, non-assignable, and non-refundable.
    e) EMS subscription plans require a minimum commitment of six (6) or twelve (12) full monthly payments, depending on the chosen plan. Early termination during this period is not permitted.
    f) Discounted off-peak plans allow session usage only during specified business hours.
    g) Subscription plans automatically renew after the initial commitment period unless previously terminated. The renewal period will match the original commitment.
    h) Members may pause their subscription for up to four (4) weeks per year; no charges apply, but weekly credits will not accrue. The subscription end date will extend accordingly.
    i) The EMS 10-Session Plan provides 10 sessions valid for one year; it cannot be terminated early or automatically renewed.

EMS TRAINING SESSIONS

  1. Each subscription plan provides weekly training credits (additional credits may be purchased). Unused credits are forfeited at the end of the week. The 10-Session Plan credits expire after one year.

  2. Sessions must be scheduled at least 12 hours in advance. Bookings made less than 12 hours prior are subject to Management approval. Missed sessions will result in forfeited credits.

  3. Members may cancel a session at least 24 hours in advance to retain the credit. Late cancellations result in forfeited credits.

  4. Members must arrive on time; late arrivals may be refused entry or have sessions shortened to avoid disruption.

SERVICE PLAN FEES

  1. An Initial Joining Fee is payable upon enrolment. This fee is non-refundable and subject to change without notice.

  2. Monthly Dues are payable in advance via automatic debit from a bank account or credit card. Failure to pay on time may result in suspension of membership and late fees. A collection fee of $15 may apply if payment cannot be processed. Legal action may be taken for unpaid balances.

  3. Monthly Dues may increase with 30 days’ notice. Notification may be posted in the Studio.

  4. The Company reserves the right to introduce new plans or adjust prices at any time.

TERMINATION OF SERVICE PLAN

  1. One full calendar month’s notice must be provided before the end of the commitment period to terminate a plan.

  2. Monthly Dues must continue to be paid until termination is effective.

  3. Early termination within a commitment period requires a fee of USD 300 , and at least half of the commitment period must be completed. Prepaid dues are non-refundable.

  4. Termination of a frozen plan requires payment of the Monthly Dues for the notice period.

  5. The Initial Joining Fee is non-refundable.

PHYSICAL CONDITION OF MEMBER

  1. Members represent that they are in good health and capable of participating in EMS training.

  2. Members must undergo a health assessment before the first session and disclose any medical conditions. Participation may be restricted based on contraindications.

  3. Members must not use the Studio if suffering from infections, contagious illnesses, open wounds, or conditions that may affect other members’ safety.

  4. The Studio may refuse entry for health, safety, or security reasons, without liability to the Company.

  5. Use of the Studio is at the member’s own risk.

EXPULSION OF MEMBER

The Company may terminate a membership:

  1. Immediately and without notice if a member’s conduct poses a threat to safety, health, or reputation.

  2. Immediately for breaches of these Rules.

  3. After notice if Monthly Dues or other payments remain unpaid.

  4. If the member is deemed unsuitable for continued enrolment.

Members terminated for any reason forfeit all rights, including paid fees, and must return any Company property.

PERSONAL DATA

  1. The Company collects, processes, and uses members’ personal data to manage memberships, payments, communication, research, legal compliance, and operational purposes.

  2. Data may be shared with agents, contractors, auditors, legal advisors, financial institutions, and government authorities as required.

  3. Members may access and correct their data by contacting the Studio and paying a reasonable processing fee.

  4. Marketing communications may be sent with prior consent, and members may opt out at any time via email at hello@surge.fitness or by updating preferences at the Studio.

OTHER TERMS

  1. Members may bring snacks and drinks; lost property will be held for three (3) months.

  2. Photography for promotional purposes may occur at the Studio.

  3. Studio hours are posted online; Management may adjust hours for maintenance or events.

  4. Smoking, alcohol, or drug use is prohibited in the Studio.

  5. Failure to enforce any rights does not constitute a waiver.

  6. Management may amend these Rules at any time; members will be notified via email.

  7. These Rules are governed by Hong Kong law.

LIMITATION OF LIABILITY

  1. Members use the Studio at their own risk. The Company, Management, and staff are not liable for injury, death, loss, or property damage, except in cases of negligence.

  2. Guests and temporary visitors are subject to the same limitations.

REFERRAL PROGRAM

  1. Referred individuals receive a free trial session with a referral card.

  2. Upon signing a contract or session package, the referred and referring member each receive a USD 60 discount.

  3. Only new members are eligible. Past members within 12 months are excluded.

  4. The Company may modify or terminate the referral program at any time without notice.
